DENREU Logo-Making Contest

The DENREU is conducting a logo-making contest. The objective is to come up with a new national logo to be used by the DENREU National Board and all its affiliates (regions, bureaus and attached agencies)

Mechanics and Submission of Entries

1. The Contest is open to all DENREU members.

2. Entry is limited to one per affiliated union (region, bureau, attached agency and central office).

3.Designs must be drawn/printed on a 1/4 white illustration board with an accompanying interpretation on a sheet of A4-size paper. Electronic copy should also be submitted.

4.The maximum number of colors is five (5).

5. Entries shall be submitted for judging during the DENREU national meeting (CNA Deliberation) in Iloilo on November 10, 2009

6. Judges, which shall be selected from among the DENREU National Board of Directors, will select the winning logo using the following criteria:

        Interpretation and Relevance to the DENREU = 50%
        Visual Impact = 25%
        Originality and creativity = 25%

7. In case of a tie (in score), the judges may decide through votation which logo will be the winner.
The creator of the winning logo shall receive a cash prize from the DENREU Western Visayas.

The DENREU Collective Negotiations Agreement (CNA) will expire on February 27, 2010 and the DENREU National Board is currently undertaking consultations and deliberations for its renegotiation.

We would like to get your inputs (comments, suggestions, and recommendations), which shall be discussed by a Renegotiating Team composed of DENREU officers in the central office, regions, bureaus and attached agencies.

Should you wish to read the contents and provisions of the current CNA, you may view it here or request for a copy at the DENREU office. (For DENREU members in regional offices, bureaus and attached agencies, please feel free to ask any of your union officers for a copy of the CNA.)

You may post your comments through this blog site (by clicking the comments link at the end of this post), email them through denreu@yahoo.com or submit them to the DENREU office. You may also discuss them with any Board of Director, and we will make sure that your concerns are addressed through the CNA.

In line with the upcoming grant of CNA incentive for the year 2009 and to ensure orderly records, the DENREU is presently updating the profiles of its general membership. Hence, all DENR Central Office employees who are interested to join the DENREU are advised to submit their application for membership not later than October 30, 2009.

Employees who will submit their applications beyond the said date will be charged with the corresponding agency fee deducted from non-members who will receive the CNA incentive for the year 2009.

Upon the invitation of DENREU Region 3 President Vilma Villegas Garcia, DENREU National President Atty. Camilo D. Garcia and other Board of Directors went to Pampanga on October 8, 2009 to act as resource persons on the whole-day seminar.

A RESOLUTION TO AUTHORIZE THE DENREU BOD/TREASURER TO DISBURSE THE AMOUNT OF P5,000.00 PESOS TO BE DONATED TO THE FUND DRIVE OF DENR CENTRAL OFFICE FOR THE FLOOD VICTIMS OF TYPHOON ONDOY

WHEREAS, the DENREU, members affected by typhoon Ondoy are among the most affected constituents of Metro Manila;

WHEREAS, the DENREU members who need immediate assistance shall benefit from the DENR Fund Drive for the Flood Victims of Typhoon Ondoy;

WHEREAS, it would be a good gesture for the DENREU to donate to the Flood Victims of Typhoon Ondoy who are members of the union. Any amount coming from the DENREU Fund would be highly commendable and would be deeply appreciated by all sectors as most humane act and timely;

WHEREAS, it would be the DENREU Board. of Directors chance to show compassion and determination to help the Flood Victims of Typhoon Ondoy;

NOW THEREFORE, among the majority vote of the members of the Board of Directors be it resolve as it is hereby resolved to authorize the DENREU Treasurer to disburse the amount of Five Thousand Pesos (P5,000.00) to be donated to the DENR Fund Drive for the Flood Victims of Typhoon Ondoy;

Res No. 2009-14: Disposal of Defective Wall Clocks and Boxes of Used Paper

A RESOLUTION TO AUTHORIZE THE CHAIRPERSON FOR WAYS AND MEANS TO DISPOSE OF DEFECTIVE WALL CLOCKS, BOXES OF USED PAPERS STOCKFILED AT THE DENREU OFFICE

WHEREAS, the DENREU, as a legitimate government association shall establish, promote and undertake a continuing education, research program leadership training within the union and among its members.

WHEREAS, the DENREU, shall promote all forms of meaningful social activities for the benefit of its members.

WHEREAS, it would be beneficial for the DENREU to dispose of the said defective wall clocks and other boxes of used papers of the previous DENREU Board of Directors stockpiled at the DENREU office, to clear and to have ample space for the DENREU Conference Room.

WHEREAS, it would be the responsibility of the Chairperson for Ways and Means to dispose of the said defective wall clocks and it is his responsibility to determine the monetary value of the said defective wall clocks and submit a report to the DENREU Board.

NOW THEREFORE, among the majority vote of the members of the Board of Directors be it resolve as it is hereby resolved to authorize the Chairperson for Ways and Means to dispose of the said defective wall clocks.

RESOLVED FURTHER, that whatever monetary value derived from the disposal of the said defective wall clocks, it would be turned over to the DENREU Treasurer;

A RESOLUTION AUTHORIZING THE DISBURSEMENT OF FUNDS TO BE USED FOR THE PAYMENT OF REGISTRATION FEE OF THE BOARD OF DIRECTORS WHO WILL BE ATTENDING THE DENREU NATIONAL MEETING IN REGION V SUBJECT TO REIMBURSEMENT AND FOR OTHER PURPOSE

WHEREAS, the DENREU National Meeting for year 2009 will be held in Legaspi, Albay from September 24-25, 2009;

WHEREAS, in accordance with the Constitution and By-Laws of the DENREU National Board, the Board of Directors (BOD) of the Central Office shall act as Secretariat of the national board;

WHEREAS, as Secretariat, the BOD shall attend the scheduled national meeting;

NOW THEREFORE, as unanimously approved by the board of directors in a meeting called for the purpose, resolved as it is hereby resolved that funds be disbursed for the payment of the registration fee of the BOD who will be attending the convention subject to reimbursement;

RESOLVED FURTHER, that additional funds be disbursed to be used as contingency fund of the BOD during the said convention;

RESOLVED FINALLY, that a copy of this Resolution be posted at the Bulletin Board for the information of the general membership.

Today is World Day for Decent Work

As the economic crisis threatens the jobs and futures of people everywhere, PSI has joined the ITUC and other Global Union Federations in calling on governments to place decent work at the centre of government actions to bring back economic growth and build a new global economy that puts people first. PSI has prepared a press release and calls on its affiliates to mobilise around the World Day for Decent Work.

The economic crisis threatens the jobs and futures of people everywhere. Policies which drive countries to restructure, outsource, subcontract and privatise their public services have led to the casualisation and informalisation of many public sector jobs. Women and young workers form by far the majority of workers who find themselves in precarious forms of work, as social spending by governments diminishes and employers look for what they see as a more ‘flexible’ and cheaper workforce.

This growing exclusion also has an alarming impact on the erosion of workers' and trade unions' rights.

“Now is the time to invest in people, says Peter Waldorff, PSI General Secretary, “in their education and health, and in care for the very young and the aged but also in education and training so as to support the transfer of workers into sectors where there is a need for more jobs, for example, the healthcare sector which is lacking an estimated 4.2 million workers worldwide. With the acceleration of climate change and global warming, now is the time to focus on the creation of green jobs and a just-transition to a low carbon economy.”

PSI has joined the ITUC and other Global Union Federations in calling on governments to place decent work at the centre of government actions to bring back economic growth and build a new global economy that puts people first.

“A real and sustainable economy in the service of the people requires the creation of decent jobs and decent public services. This crisis must not be used as an excuse to create more precarious jobs and working conditions. Quality public services are essential in building strong economies and inclusive societies, and quality public services cannot be achieved without decent, stable working conditions”, concludes Waldorff.

The recently concluded G20 Summit in Pittsburgh presented some significant advances on labour issues, with a greater role to the ILO, a forthcoming G20 Labour Ministers meeting in 2010 and a promise that global growth should not take place on the detriment of internationally recognised labour standards. However, the just-issued ITUC/TUAC evaluation of the Summit concludes that progress to re-regulate the financial market fell far short of the actions needed to prevent future speculative bubbles.

PSI calls on its affiliates to mobilise around World Day for Decent Work and call for the creation of decent jobs and the respect of trade union rights for all.

Nat'l Resol. #8: Calling for a STATUS QUO on the Transfer of DENR Regions 4A & 4B

DENREU NATIONAL BOARD RESOLUTION NO. 8

RESOLUTION CALLING FOR A STATUS QUO ON THE TRANSFER OF THE REGIONAL OFFICES OF DENR REGIONS IV-A (CALABARZON) AND IV-B (MIMAROPA)

WHEREAS, Executive Order Nos. 246 and 682 were issued, setting Calamba City, Laguna and Calapan City, Oriental Mindoro as the Regional Centers of the CALABARZON and MIMAROPA Regions, respectively;

WHEREAS, the aforementioned Executive Orders were issued without prior consultation from the rank-and-file employees who would be most severely affected;

WHEREAS, the management of the DENR CALABARZON and MIMAROPA Regions initiated a series of actions to physically transfer their Regional Offices to Calamba City and Calapan City, respectively, even in the absence of a DENR Building and other amenities at the Regional Government Center;

WHEREAS, the affected employees of the CALABARZON and MIMAROPA Regions have vigorously exhausted all efforts to present to the DENR Regional and Central officials their concerns regarding the transfer, but their welfare and those of their families were seemingly overlooked;

WHEREAS, the DENREU has the primary duty to protect the interest and welfare of rank and file employees and act in accordance with the principles of transparency and good governance;

WHEREAS, the transfer of the CALABARZON and MIMAROPA Regional Offices are being done without a more comprehensive study of its negative impact on the financial, physical, and personal well-being of the rank and file employees, affecting their efficiency and effectiveness in the discharge of their duties and thus hampering the DENR’s services to the public in the said regions;

WHEREAS, DENR clientele have expressed opposition to the transfer of the Regional Offices whose current location is more convenient and accessible to their needs;

WHEREAS, the cost of the physical transfer of the CALABARZON and MIMAROPA Regional Offices is highly disadvantageous to the government, and contrary to Administrative Order No. 103 directing all government agencies to practice austerity measures as this necessitates undue expenses for office rentals, granting of relocation and/or dislocation allowances, and other measures to address the transfer;

WHEREAS, the transfer of Regional Offices is untimely for employees and their families in light of the school calendar year;

WHEREAS, the plantilla positions of the former DENR Region IV have not been settled when it was split into CALABARZON and MIMAROPA Regions;

WHEREAS, the transfer of the Regional Offices may force rank and file employees to resign because they will not be able to sustain the costs that the physical transfer may entail, which is contrary to the right of government employees to security of tenure; and

WHEREAS, similar Executive Orders directing the transfer of National Offices of other government agencies such as the Dept. of Agriculture and the Dept. of Agrarian Reform to Ilagan, Isabela and Davao City, respectively, have been held in abeyance by HER EXCELLENCY PRESIDENT GLORIA MACAPAGAL-ARROYO based on the clamor of their employees.

NOW THEREFORE, upon motion of Romeo E. Golong, President of DENREU Region 8, and duly seconded by Ricardo C. Soriano, President of DENREU Region 2, BE IT RESOLVED AS IT IS HEREBY RESOLVED, to STRONGLY OPPOSE the transfer of the DENR CALABARZON and MIMAROPA Regional Offices until the welfare of the concerned employees have been fully addressed.

RESOLVED FURTHER, to ask the Honorable Secretary to order a STATUS QUO on the transfer of the DENR CALABARZON and MIMAROPA Regional Offices.

RESOLVED FURTHERMORE, to ask the Honorable Secretary to order the Regional Executive Directors of the two Regions to conduct a more thorough study and dialogue, together with the Regional DENREU Board of Directors and the rank and file employees, on the impact of the transfer, and to consistently inform the employees on the result of the same in keeping with the principles of transparency, accountability, and good governance.

RESOLVED FURTHERMOST, that all members of DENREU nationwide, shall collectively support the cause of the DENREU CALABARZON and MIMAROPA to protect their rights and interests.

RESOLVED FINALLY, that copies of this resolution be furnished to the Office of the President, the Office of the Presidential Adviser on New Government Centers, the DENR CALABARZON and MIMAROPA Regional Executive Directors. Copies of this resolution be posted on conspicuous places within the premises of all DENR offices nationwide for the information of the general membership.

A RESOLUTION THANKING UNDERSECRETARY RAMON J.P. PAJE AND ASSISTANT SECRETARIES RICARDO S. ISIP AND JUAN MIGUEL T. CUNA FOR ISSUING A STATUS QUO ORDER FOR THE PROPOSED TRASFER OF DENR-MIMAROPA TO CALAPAN CITY, ORIENTAL MINDORO

WHEREAS, the DENREU is the sole and exclusive bargaining agent of all DENR rank-and-file employees;

WHEREAS, the President of the Republic of the Philippines issued Executive Order No. 682 designating Calapan City, Oriental Mindoro as regional center for MIMAROPA region and thereby ordering the transfer of all government regional offices of MIMAROPA to Calapan City;

WHEREAS, the employees of DENR-MIMAROPA requested the Honorable Secretary, Jose L. Atienza, Jr. to hold in abeyance the transfer of the regional office of the DENR to Calapan City due to various legal and reasonable reasons which has to be addressed first by the office;

WHEREAS, by reason of such request, Undersecretary Ramon J.P. Paje and Assistant Secretaries Ricardo S. Isip and Juan Miguel T. Cuna issued a Status Quo Order for the proposed transfer until further notice by the Secretary ;

WHEREAS, the DENREU National Board finds it proper and imperative to thank the above-mentioned DENR officials for their support to the cause of the DENR-MIMAROPA employees;

WHEREAS, the DENREU National Board is hoping that a similar status quo order be issued for the transfer of DENR-CALABARZON pending resolution of the concerns of the employees;

NOW THEREFORE, upon the unanimous motion of all those present, resolved as it is hereby resolved, that a message of thanks and appreciation be extended and conveyed to Undersecretary Ramon J. P. Paje and Assistant Secretaries Ricardo S. Isip and Juan Miguel T. Cuna for their valuable support to the cause of the employees of DENR;

A RESOLUTION THANKING THE HONORABLE SECRETARY, JOSE L. ATIENZA, JR. FOR GRANTING ANNIVERSARY BONUS AND FINANCIAL SUBSIDY TO ALL DENR EMPLOYEES

WHEREAS, the DENREU is the sole and exclusive bargaining agent of all DENR rank-and-file employees;

WHEREAS, the DENREU requested the Honorable Secretary, Jose L. Atienza, Jr., through various national board resolutions, for the grant of anniversary bonus and financial subsidy to all DENR employees nationwide;

WHEREAS, the said requests of the DENREU was favorably indorsed by the Assistant Secretary for Management Services, Ricardo S. Isip to the Honorable Secretary;

WHEREAS, by reason of such favorable indorsement, the Honorable Secretary granted the request of the DENREU and the employees were granted the financial subsidy of Php2,000.00 (except DENR Region 8) and anniversary bonus of Php3,000.00 (except DENR Region 1);

WHEREAS, the DENREU National Board finds it proper and imperative to thank the Honorable Secretary and the Honorable Assistant Secretary for Management Services;

NOW THEREFORE, upon the unanimous motion of all those present, resolved as it is hereby resolved, that a message of thanks and appreciation be extended and conveyed to the Honorable Secretary, Jose L. Atienza, Jr. for granting the request of the DENREU for anniversary bonus and financial subsidy for all DENR employees;

DENREU NATIONAL BOARD RESOLUTION NO. 11

A RESOLUTION REITERATING THE REQUEST FOR THE

CIVIL SERVICE COMMISSION TO APPROVE THE PETITION FILED BY THE DENREU FOR ACCREDITATION AS A NATIONAL UNION

WHEREAS, the DENREU is the sole and exclusive bargaining agent of all DENR rank-and-file employees;

WHEREAS, within the DENR, there are several registered unions in the Central, Regional and Bureau Offices and Attached Agencies with common goals and aspirations;

WHEREAS, in answer to the call of the Civil Service Commission (CSC) for a “One Union, One Agency” policy, all registered unions in the DENR formed a national union named as DENR Employees Union (DENREU) and filed a Petition for Accreditation before the CSC sometime in the year 2007;

WHEREAS, the formation of the DENREU as a national union is an exercise of the employees’ constitutional right to form a union that shall embody their ideals and aspirations. Likewise, the same was formed in order for the DENR employees to have an effective and collective bargaining power with the DENR Management regarding employees’ rights, welfare and benefits;

NOW THEREFORE, upon the unanimous motion of all those present, resolved as it is hereby resolved, to request the Civil Service Commission (CSC) to approve the Petition for Accreditation of the DENREU as a National Union which is pending in that Office for quite a time now.

RESOLVED FURTHER, that a copy of this resolution be furnished the Public Sector Labor-Management Council (PSLMC) and the Bureau of Labor Relations (BLR) for information and guidance.

RESOLVED FINALLY, that a copy of this resolution be posted in all DENREU Bulletin Boards for the information and guidance of the general membership.

A RESOLUTION DIRECTING THE DENREU AFFILIATES TO CONDUCT A CONSULTATIVE MEETING WITH OTHER AGENCIES OF THE GOVERNMENT IN THEIR RESPECTIVE AREAS OF JURISDICTION REGARDING GSIS ISSUES

WHEREAS, the DENREU is the sole and exclusive bargaining agent of all DENR rank-and-file employees;

WHEREAS, the DENREU members are encountering several problems with their benefits with the Government Service Insurance System (GSIS);

WHEREAS, the problems of the DENREU members are likewise experienced by other government employees in the different agencies of the government;

WHEREAS, there is a need for the DENREU to tie up with other agencies so that a collective and concerted action can be done to force the GSIS to address all the problems of the employees;

NOW THEREFORE, upon the unanimous motion of all those present, resolved as it is hereby resolved, that all DENREU affiliates are hereby required to conduct a consultative meeting with other government agencies in their respective areas of jurisdiction so that a collective and concerted action can be done;

RESOLVED FURTHER, that a copy of this Resolution be furnished the Honorable Secretary, Jose L. Atienza, Jr. for his information and a copy of the same be posted in all DENREU Bulletin Boards for the information of the general membership.

DENREU NATIONAL BOARD RESOLUTION NO. 13

A RESOLUTION DEFINING THE JURISDICTION OF THE DENREU NATIONAL BOARD AND ITS AFFILIATES ON ISSUES CONCERNING EMPLOYEES’ WELFARE AND BENEFITS

WHEREAS, the DENREU as a national union is comprised of the different unions in the central, regional and bureau offices and attached agencies;

WHEREAS, these different DENREU unions within the DENR are considered as affiliates;

WHEREAS, these affiliates retains its autonomy in all matters involving its existence and operations in accordance with its respective constitution and by-laws;

WHEREAS, by reason of such autonomy, the DENREU affiliates shall have exclusive jurisdiction over all issues and concerns relative to employees’ rights, welfare and benefits emanating from their respective area of jurisdiction;

WHEREAS, to avoid confusion in handling such issues and concerns and to respect and maintain the autonomy of DENREU affiliates, the following rules are hereby adopted:

1. All issues and concerns brought before the DENREU by members must be supported by concrete and direct supporting evidence and documents together with a written request or complaint for the DENREU to act on the matter. However, the Board of Directors may initiate on its own the conduct of an investigation on issues and concerns involving employees’ rights, welfare and benefits.

2. No issue or concern will be acted upon by the DENREU, whether national or affiliate, unless the same involves employees’ rights, welfare and benefits.

3. An issue or concern shall be handled by the DENREU affiliate that has jurisdiction over the area where the same happened. If the issue or concern pertains to an employee, the same shall be handled by the affiliate where the employee is a member.

4. If in case a complaint is filed by a member against a fellow member, the same shall first be referred to the DENREU Grievance Committee that has jurisdiction over the matter. However, if the complaint is filed by a member against a non-member or vice-versa, the same shall be referred to the DENR Grievance Machinery.

5. All issues and concerns of national importance shall be handled by the DENREU National Board. However, all specific issues, concerns and complaints involving employees and members, may likewise be brought to the DENREU National Board at the instance of the DENREU affiliate concerned.

6. The DENREU National and all its affiliates shall only be represented by the duly elected members of the DENREU National Board and the affiliates’ Board of Directors, respectively. In no case shall a member or an officer of the union represent the DENREU whether national or its affiliates in all matters involving employees’ rights, welfare and benefits.

7. All official acts of the DENREU shall be only through a resolution of the Board of Directors passed and approved for the purpose.

NOW THEREFORE, upon the unanimous motion of all those present, resolved as it is hereby resolved, that the above rules defining the jurisdiction of DENREU affiliates and the DENREU National Board be approved and adopted.

RESOLVED FURTHER, that a copy of this resolution be furnished the Secretary Jose L. Atienza, Jr., Assistant Secretary Ricardo S. Isip, Assistant Secretary Juan Miguel T. Cuna, all Regional Executive Directors, Bureau Directors and Heads of Attached Agencies for their information and guidance.

RESOLVED FINALLY, that a copy of this resolution be posted in all DENREU Bulletin Boards for the information and guidance of the general membership.

DENREU NATIONAL BOARD RESOLUTION NO. 14

A RESOLUTION DIRECTING THE DENR MOWELFUND TO GRANT AND COMPLY IMMEDIATELY THE DEMANDS OF THE DENR EMPLOYEES AS REPRESENTED BY THE DENREU

WHEREAS, the DENREU is the sole and exclusive bargaining agent of all DENR rank-and-file employees;

WHEREAS, the DENREU members are likewise members of the DENR Mowelfund with a monthly contribution of Php75.00;

WHEREAS, despite such membership, the employees have no representative in the Board of Trustees of the Mowelfund instead the Board is composed of the Regional Executive Directors;

WHEREAS, employees could not feel that they are well represented by the Regional Executive Directors in the Board as various resolutions affecting the general membership were passed and approved by the Board without due consultation and information with the members;

WHEREAS, the employees as represented by the DENREU are asking the Mowelfund for the following demands:

1. The DENREU must be given seven (7) seats in the Board of Trustees.
2. The Mowelfund must conduct a general assembly immediately.
3. The Mowelfund must furnish the employees through the DENREU with a copy of the audited financial report of the funds of the association.

WHEREAS, if in case the Mowelfund fails to comply with the above-mentioned demands, all DENREU members nationwide will withdraw their membership to the Mowelfund.

NOW THEREFORE, upon the unanimous motion of all those present, resolved as it is hereby resolved, that the above-mentioned demands be issued to the DENR Mowelfund and urged its immediate compliance;

RESOLVED FURTHER, that the DENR Mowelfund be required to explain why despite the invitations sent during the 3rd and 4th DENREU National Conventions and the National Presidents Meeting, no representative appeared before the union.

RESOLVED FINALLY, that a copy of this Resolution be furnished the Honorable Secretary, Jose L. Atienza, Jr. and Undersecretary Ramon JP. Paje for information and a copy of the same be posted in all DENREU Bulletin Boards for the information of the general membership.

We are employees of the Department of Environment and Natural Resources (Region 4 A and B) and its attached line bureaus, namely, the Environmental Management Bureau (EMB Region 4) and Mines & Geosciences Bureau (MGB Region 4 A and B).

We write this letter to air our strong opposition to the impending full transfer of our offices from Roxas Boulevard, Manila to Calamba, Laguna and to Calapan, Mindoro, as directed under Executive Orders 682 and 246. Our objection is based on the following reasons:

1. We believe the transfer is a form of constructive dismissal. It is meant to force us to leave the service since going to Laguna and Mindoro from Manila will be very costly for us. Our measly pay will not be enough to cover necessary travel expenses; our families reside in Metro Manila.

2. The transfer will mean dislocation, not only for us, the employees, but also for our respective families as it will alienate them from us. We may no longer be able to closely or regularly attend to our children’s education and welfare. Such alienation must be discouraged because the family is the foundation of the nation, and public policy cherishes and protects it as a basic social institution.

3. People from Marinduque, Romblon and Palawan, who are also our clients, also oppose the transfer since there are no direct routes by boat or by airplane to Mindoro. To them, the most accessible location is still Metro Manila. They sincerely believe that the transfer will not improve, but will worsen instead, the service from our agency.

4. The relocation site is within a flood-prone area. This is the place where MGB, the agency that gives the Provincial Disaster Coordinating Center reports on the geological hazards of a given province, will transfer.

5. If a full transfer is pushed through, the government will have to spend a lot more for rent or the construction of a new building in both Calamba and Calapan. Neither expense will be necessary if we stay in the DENR-owned building on Roxas Boulevard, which is strategically located. Not only that, we also have to move office equipment and volumes of vital records, such as survey plans, land titles and cadastral maps, which should be kept intact.

6. There had been similar orders for the transfer of the national offices of the Department of Agriculture and the Department of Agrarian Reform to Ilagan, Isabela and to Davao City, respectively. However, because of the objection of their employees and their clients, President Gloria Macapagal-Arroyo rescinded the orders.

We believe in our right to job security. We believe that the people we swore to serve deserve better.

Res No. 2009-11: Directing Mr. Galo Martinez, Jr. to Explain Acts Prejudicial to the Union

A RESOLUTION DIRECTING MR. GALO MARTINEZ, JR. TO EXPLAIN WHY HE SHOULD NOT BE METED WITH DISCIPLINARY ACTION FOR COMMITTING ACTS PREJUDICIAL TO THE UNION

WHEREAS, the DENREU Constitution and By-Laws provides that the protection and promotion of the common interest and well-being of its members shall be the primary concern and responsibility of the union.

WHEREAS, issues regarding alleged anomalous acts in PENRO Quezon have come to the attention and have caused confusion among union members.

WHEREAS, the Board of Directors seek to enlighten the members by clarifying the issues at hand through the following chronology of events:

During a caucus among DENREU Board of Directors on June 30, 2009, Mr. Galo Martinez, Jr. discussed allegations of anomalous practices in PENRO Quezon.
As a result of this discussion, some members of the Board supported Mr. Martinez’ campaign to fight alleged graft and corruption by signing DENREU Resolution No. 2009-06 on June 30, 2009, denouncing the acts of certain DENR officials who tolerate and exert efforts to perpetuate the anomalous practices in PENRO Quezon. Members of the Board who affixed their signature to the resolution were assured that the document is to be used solely for the purpose of ensuring proper financial management in PENRO Quezon, and not for other purposes.
The members of the Board later found out that Mr. Martinez has previously requested the conduct of an investigation of alleged anomalous practices in PENRO Quezon through a memorandum to Undersecretary Mary Ann Lucille L. Sering dated March 10, 2009. Mr. Martinez signed the memorandum as the DENREU Executive Vice President. He did not, however, inform the Board of his action prior to submitting this memorandum. Hence, the allegations in his memorandum do not reflect the position of DENREU.
The members of the Board also found out that on March 14, 2009, Undersecretary Sering issued Special Order No. 2009-224 creating a Fact-Finding Team to investigate the alleged anomalous practices in PENRO Quezon. In the Special Order, Atty. Camilo D. Garcia, chief of the Law Enforcement and Licenses Division, Legal Service, was directed to render assistance to the Fact-Finding Team.
On July 2, 2009, Mr. Martinez filed a leave of absence to the DENREU effective July 6, 2009 to December 31, 2009.
On August 7-10, 2009 Mr. Martinez sought the support of union members through a signature campaign stating that “Sinusuportahan namin ang pakikibaka ni kasamang Galo Martinez, Jr., Executive Vice President, DENREU na maisaayos ang pamamahala ng pananalapi sa PENRO Quezon. Hiling namin sa mahal na Kalihim na huwag ito ipagwalang bahala.” Union members who affixed their signature to the campaign were assured that the document is to be used solely for the purpose of ensuring proper financial management in PENRO Quezon, and not for other purposes.
On August 6, 2009, Mr. Martinez issued a memorandum for the Secretary in reaction to an Evaluation Report submitted by Atty. Camilo D. Garcia regarding the alleged anomalous practices in PENRO Quezon. The memorandum was signed by Mr. Martinez as Executive Vice-President of DENREU. Attached to this memorandum as documentary evidence are (1) DENREU Resolution No. 2009-06 signed by some DENREU Board of Directors, and (2) the signatures of numerous union members who supported Mr. Martinez’ campaign. In the memorandum, Mr. Martinez asserted several statements that can arguably be considered as hasty, inappropriate and unprofessional, and can be deemed as a deeply personal attack against the supervising lawyer, Atty. Camilo D. Garcia, who also happens to be the DENREU National President.
On August 12, 2009, members of the Board received information that the Evaluation Report dated July 30, 2009 by Atty. Garcia. Enumerated clearly and intelligibly Atty. Garcia’s comments on the affidavit-answer of the respondent to the case and that this evaluation report appears to be written in a professional manner and without personal attacks against those involved in the case. Members of the Board were therefore surprised with Mr. Martinez’ subsequent personal attacks and hasty statements against Atty. Garcia.
On August 13, 2009, Mr. Martinez disseminated an open letter explaining his campaign to stand against anomalous acts. The open letter was signed by Mr. Martinez as Executive Vice-President of DENREU.
On August 13, 2009, the DENREU issued an advisory to union members that Mr. Martinez has filed a leave from the Union effective July 6, 2009 to December 31, 2009, and that the issue of alleged anomalous acts in PENRO Quezon is already under investigation.
On August 14, 2009, the DENREU received several documents expressing the member’s retraction of their initial signatures in support of Mr. Martinez. The signature campaign reflect the members’ withdrawal of support to Mr. Martinez.

WHEREAS, members of the Board have no intention of taking neither Atty. Garcia’s nor Mr. Martinez’ side, and seek to objectively evaluate the issue using reasonable and fair judgment and keeping in mind that the union’s primary concern is to protect and promote the common interest and well-being of union members.

WHEREAS, current members of the Board strongly feel that Mr. Martinez has used their signature in DENREU Resolution No. 2009-06 to malign a co-officer of the union, and has consequently violated their trust.

The Board of Directors did not sign Resolution No. 2009-06 in reaction to the Evaluation Report of Atty. Garcia. Clearly, Resolution No. 2009-06 has no direct connection to the Evaluation Report of Atty. Garcia, nor to the subsequent reaction of Mr. Martinez
While current members of the Board have consistently supported Mr. Martinez’ previous campaigns against graft and corruption, they now feel that they were betrayed and that their rights were violated because they were not aware that the signed resolution will be used in reaction to an evaluation report submitted by Atty. Garcia. Attaching the signed resolution to Mr. Martinez’ memorandum to the Secretary dated August 6, 2009 was done without DENREU’s knowledge and authority.

WHEREAS, the signature campaign was supported by numerous union members without knowledge of the Evaluation Report submitted by Atty. Garcia.

The signatures of the union members were not affixed in reaction to Atty. Garcia’s evaluation of the case. Clearly, the signature campaign has no direct connection to the Evaluation Report of Atty. Garcia, nor to the subsequent reaction of Mr. Martinez.
Several union members who affixed their signature in the campaign felt betrayed and their rights violated because they were not aware that the same will be used in reaction to an evaluation report submitted by Atty. Garcia. Attaching their signatures to Mr. Martinez’ memorandum to the Secretary dated August 6, 2009 was done without their knowledge and authority.

WHEREAS, Mr. Martinez’ actions have become prejudicial to the Union as an organization and to its members. Specifically:

He attached DENREU Resolution No. 2009-06 as documentary evidence to his memorandum to the Secretary dated August 6, 2009 without the DENREU’s knowledge and authority.
He attached the signatures of numerous union members who supported his campaign as documentary evidence to his memorandum to the Secretary dated August 6, 2009 without their knowledge and authority.
He used the signatures of the Board in DENREU Resolution No. 2009-06 to malign a co-officer of the union.
He asserted several inappropriate and unprofessional statements and used the signatures of the Board in DENREU Resolution No. 2009-06 to malign a co-officer of the union.

WHEREAS, pursuant to the DENREU Constitution and By-Laws, the “commission of any act prejudicial and/or inimical to the interest of the Union as determined by the Board of Directors shall be a ground for disciplinary action.”

NOW THEREFORE, by motion of majority of the members of the Board of Directors, be it resolved as it is hereby resolved to direct Mr. Galo Martinez, Jr. to explain within seventy-two (72) hours from receipt of this resolution why he should not be meted with disciplinary action for committing the above-enumerated acts prejudicial to the Union.

RESOLVED FURTHER, that Mr. Galo Martinez, Jr. should be directed to refrain from signing as the DENREU Executive Vice President in consideration of his leave of absence from the union effective July 6, 2009 to December 31, 2009, and since the same has not been recalled and/or revoked and remains effective.

RESOLVED FINALLY, that a copy of this resolution be posted at the Bulletin Board for the information of the general membership.

APPROVED AND ADOPTED this 14th day of August 2009 during an emergency meeting at the DENREU Conference Room, DENR Compound, Visayas Avenue, Diliman, Quezon City.

MANILA, Philippines -- President Gloria Macapagal-Arroyo has signed into law a joint congressional resolution standardizing the pay of more than one million government personnel.

Arroyo signed Resolution 4, or the Salary Standardization Law III, at the airport lounge yesterday just before leaving on a chartered Philippine Airlines flight for a working visit to Japan.

The resolution, which has the effect of law, introduces new compensation and position scale for civilian, military and uniformed personnel in government.

In essence, it “overhauls not only the pay, but [also] the plantilla,” Malacañang officials said.

It seeks to address the salary overlaps created by the current compensation system, such as varying allowances and benefits, which have distorted pay of government employees, they said.

The increase in pay could be as high as 50 percent, and will be implemented over a period of four years, beginning in July.

For instance, the salary grade of public school teachers has been raised one notch, giving them a basic pay of between P18,088 and P19,527, or a 50-percent increase when fully implemented.

“In effect, we’re giving the private sector good competition. We’re encouraging competent workers to join the government. Now government salaries can already be competitive,” said deputy presidential spokesperson Lorelei Fajardo. --TJ Burgonio

House OKs measure raising public servants' salaries

MANILA, Philippines - The House of Representatives has approved on third and final reading the measure seeking to raise the salaries of public servants, including politicians.

In a text message to reporters, House Speaker Prospero Nograles hailed the passage of the Salary Standardization Law III that was passed Wednesday evening, or almost a week after President Gloria Macapagal Arroyo certified the bill as urgent.

“Position classification and salary grades in both national and local governments are rationalized to effect the biggest ever upwards hikes or adjustments," Nograles said, adding that the bill would "help our public servants cope with increases in costs of living."

The new system will increase salaries for government employees ranging from the rank-and-file to elected officials. It will also apply to all civilian government personnel, whether regular, casual or contractual, appointive or elective, full-time or part-time.

SSL III groups positions in government into three categories: the sub-professional category, which includes those involved in manual or clerical work or those engaged in arts, crafts, and trades; the professional category, which involves those exercising their profession through formal education or training; and the executive category, which includes managerial positions in executive, legislative, and judicial functions.

Under the proposal, the present 33 salary grades and eight steps per salary grade will be retained, but salary grades will be rationalized to avoid overlaps.

It will be implemented within four years starting July 1, 2009, but salary hikes for the incumbent president, vice president, and members of Congress will only take effect after their terms. - Aie Balagtas
